Below is our “corporate certificate” issued to us
by the Department of Treasury of the State of New Jersey.
As in every state of the United States,
every company “must” have a unique name that is “not”
the same as another company’s name.
This is to among other things, avoid confusion in the consumer or public’s eye.
When a corporation is formed or “registered” with the state,
the name for which it is registered becomes this corporations identity.
There should “never” be two alike.
It is “against the law.”
Unfortunately, there are those who do not follow
the law and believe they are above it.
After a Settlement Agreement was signed by “TWO PARTIES”
and recorded with the District Court of New Jersey.
This other company “Red Diamond Co.” filed a cancellation on
two of National Sportswear Incorporated Federal Trademarks
“National Sportswear” including one to which they ” admitted in a Settlement to having never used.”
In their cancellation they proclaimed with the United States Federal Trademark Office
that our New Jersey address in Neptune New Jersey was in their territory.
When in fact, it is in our territory.
Furthermore the Attorney they hired to represent them in filing these cancellations was not of same Law Firm who
they hired and represented them in the Settlement Agreement.
Instead, this other attorney, without notice to National Sportswear Inc or the Law Firms on the Settlement Agreement, was notified by a New Jersey District Court Judge that he was innelegible to practice law and ordered not to prior to filling these unjustly cancellations of our “non-contestable federal trademarks”. In his futile and frivolous cancellations he presents “as evidence” the very Settlement Agreement and releases it in a public domain, “the TTAB” thereby causing one more breach of the Settlement Agreement “it’s confidentiality.” Upon immediate receipt of the cancellation proceeding notice by the United States Federal Trademark Office on National Sportswear Inc. Trademarks, National Sportswear Inc. sent “both law firms” notice of several Breaches caused by Red Diamond and this Law Firm on the very Settlement Agreement.
The Law Firm that represented Red Diamond Co. in the Settlement Agreement notified us that ” they no longer represent Red Diamond Co.” and that they would forward our notice to them.
The Attorney who represented Red Diamond Co. in their “cancellations of our Federal Trademarks” ignored our request to stop the proceeding and remove all “non-public confidential material” and instead responded with further threats.
We allowed them both Red Diamond Co and their Law Firm 5 days to cure. Instead, they continued the proceeding of cancellations and caused major financial burden on National Sportswear Inc.
We have filed a complaint with the New Jersey Bar’s Ethical Committee on the Attorney who represented Red Diamond Co. in their “Frivolous and unwarranted Cancellation” and “numerous other breaches of the Settlement Agreement.”
To date we have remained silent at the request of the New Jersey Bar Ethical Committee
while they proceeded with their investigations.
Red Diamond Co. attorney is now facing a “Public Hearing” with the New Jersey Bar Ethics Committee on several violations including but not limited to RPC 3.1 and RPC 3.3(a)(2).
To date January 9th 2019 neither Red Diamond Co., nor their attorney have made offer of restitution of damages and legal costs, caused by cancellations, breach of Settlement or removed the confidential agreement from public domain.
We will keep you posted on this progress and future progress with Red Diamond Co.
